1. Agreement to Terms
Welcome to www.borealisarcticexpedition.ca (the “Site”), operated by Borealis Arctic Expedition (“we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms & Conditions (the “Terms”). If you do not agree to these Terms, please do not use the Site.

2. Use of the Site
a. You may use the Site for lawful purposes only. You must not use the Site in any way that violates applicable laws or infringes our or any third party’s rights.
b. You represent that you are at least the age of majority in your province/territory of residence and legally capable of entering into a binding contract.
c. We reserve the right to refuse service or access to the Site to anyone for any reason at our sole discretion.

3. Intellectual Property
All content on the Site — including text, images, branding, logos, designs, graphics — is our property or licensed to us and is protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, modify, transmit, publish, create derivative works from, or in any way exploit the content without our written consent, except for personal, non-commercial use.

4. Products / Services
If the Site offers products or services:
a. All orders are subject to product availability and acceptance.
b. We reserve the right to limit or cancel orders in our sole discretion.
c. Prices, specifications and availability may change without notice

4. User Contributions / Comments / Reviews
If the Site allows user comments, reviews or other user-generated content:
a. You retain ownership of your content, but you grant us a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, display and perform the content in connection with the Site.
b. You agree not to post content that is unlawful, defamatory, obscene, infringing, or otherwise objectionable. We reserve the right to remove or refuse any user content at our sole discretion.

5. Acceptable Use & Prohibited Activities
You agree not to:

• Use the Site in any way that interferes with or disrupts it.

• Attempt to gain unauthorised access to parts of the Site or its systems.

• Use the Site for any fraudulent or unlawful purpose.

• Upload or transmit viruses or malicious code.

• Harvest or collect personal data of other users without authorization.

6. Disclaimer of Warranties
The Site is provided on an “as is” and “as available” basis. We make no warranties, express or implied, about the Site’s operation or the information, content, materials or products included. To the fullest extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose and non-infringement.

7. Limitation of Liability
We will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of or inability to use the Site or products/services purchased through it. Our total liability arising out of or related to these Terms will not exceed the amount paid by you (if any) to purchase products/services via the Site in the twelve (12) months preceding the claim.

8. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Québec and the laws of Canada applicable therein. You agree that any dispute arising from or relating to these Terms or your use of the Site shall be resolved exclusively in the courts of Montréal, Québec, Canada.

9. Changes to Terms
We may revise these Terms at any time by posting the revised version on the Site. Your continued access to or use of the Site after such changes constitutes your acceptance of the revised Terms.

10. Entire Agreement
These Terms, together with our Privacy Policy (if applicable) and any additional terms posted on the Site, constitute the entire agreement between you and us regarding the Site’s use, and supersede all prior or contemporaneous communications.
